Welcome to the latest edition of the Sisvel Insights weekly round-up, aggregating news stories, analyses and data points affecting the SEP world that have caught our eye over the past seven days.

The European Commission has revised two key licensing-related instruments: the Technology Transfer Block Exemption Regulation (TTBER) and the Technology Transfer Guidelines (TTGs).

In a noteworthy departure from the draft circulated last summer, the final guidelines text stops short of creating an explicit safe harbour for licensing negotiation groups (LNGs), although the Commission appears to be receptive to them. Meanwhile, increased scepticism of patent pools is evident in several changes to provisions setting out their obligations.

Despite the tone of the language, though, the overall effect of the new guidelines is likely to be business more or less as usual: best-in-class patent pools will continue to operate largely as they have done; while, on the other hand, LNGs may find it hard to get off the ground, particularly in the face of open opposition from US regulators.

In other policy news, China’s State Council has promulgated new Regulations of the People’s Republic of China on Countering Unjustified Extraterritorial Jurisdiction by Foreign States, which provide Chinese policymakers with a toolkit for countering long-arm court orders. Though primarily addressed at foreign sanctions targeting Chinese companies, observers have highlighted their potential applicability to cross-border patent and rate-setting judgments. Whether they will be used that way in practice remains to be seen.

Elsewhere, Wilus has brought Wi-Fi 6 patent infringement claims against TP-Link in the Eastern District of Texas; and the Sisvel POS licensing programme welcomed three new licensors: BlackBerry, JVCKENWOOD and SK Telecom.
